Commissioners Approve Order Regulating Use of Certain Fireworks

During their meeting on Monday, December 13, Brown County Commissioners passed an order prohibiting or restricting certain fireworks in unincorporated areas of Brown County.  The order states that the Texas Forest Service has determined drought conditions exist in Brown County and the Commissioners Court of Brown County has determined danger of fire in the unincorporated areas of Brown County is greatly enhanced by the extremely dry conditions now existing.  Brown County is also under a Burn Ban at this time.  (A link to the Order is found below)

The order states:

A person may not sell, detonate, ignite or in any way use fireworks classified as  “skyrockets with sticks” under 49 C.F.R. part 173.100 (r)(2) (10-01-86 edition) or missiles with fins in any portion of the unincorporated areas of Brown County.  This order does not prohibit permissible fireworks as authorized in Occupations Code Section 2154.003(a).

A person commits an offense if the person knowingly or intentionally violates a prohibition established by this Order.  An offense under this order is a Class C Misdemeanor.

The order expires on the date the Texas Forest Service determines drought conditions no longer exist in the county or January 1, 2022, whichever is earlier.

In other business items on the agenda:

  • Approved the Treasurer’s Report showing cash and other assets as of November 30, 2021 in the amount of $15,212,553.96.
  • Took no action on the Burn Ban, meaning the Burn Ban remains in effect.
  • No action taken for lack of a motion on the purchase of a COVID 19 disinfectant machine.
  • Gave approval for the County Sheriff to accept a donation from Buckmasters of 12 green light sights valued at approximately $6,000, a donation of $100 to the Sheriff’s Department from Blevins Body Shop and donation of a piece of exercise equipment to be used in the Fit for Duty Program.
  • Gave approval for the County Sheriff to purchase a video interview system used in the two interview rooms.  Cost is $11,098.28 to come out of the Sheriff’s general operating budget
  • Approved payment of bills
